Article 1: Purpose and scope

These General Terms of Use (GTU) define the conditions governing access to and use of the www.la-jonx.ch website, as well as the rules applicable to the use of content and creations of La Jonx Suisse Sàrl (hereinafter “La Jonx”).

Access to and use of the website require compliance with these terms.

Article 2: Intellectual property

All creations and content available on www.la-jonx.ch, including illustrations, posters, drawings, graphics, photographs, texts, visual elements and graphic creations, are protected under applicable Swiss law, in particular the Federal Act on Copyright and Related Rights (CopA).

Unless otherwise stated, the rights relating to these creations belong to La Jonx or are used by La Jonx with the permission of their respective rights holders.

Article 3: Physical posters purchased from La Jonx

The purchase of an original La Jonx poster entitles the purchaser to freely display the physical copy purchased.

The poster may in particular be displayed in:

• a private residence
• an office
• a shop or other business premises
• a restaurant or café
• a hotel
• professional premises
• or any other private place or place accessible to the public.

No additional licence is required merely to display the physical copy purchased.

This permission applies exclusively to the physical copy acquired.

The purchase of a poster or any other La Jonx product does not transfer any copyright or exploitation rights relating to the reproduced work.

Article 4: Reproduction and use of visuals

Unless La Jonx has given prior written permission or a statutory exception applies, it is prohibited to reproduce, copy, download for reuse, digitise, print, modify, disseminate, distribute or exploit a La Jonx creation.

In particular, it is prohibited to obtain an image or visual from:

• the www.la-jonx.ch website
• La Jonx social media accounts
• a photograph of a poster
• a digital file
• or any other source

for the purpose of making an unauthorised reproduction.

In particular, it is prohibited to print, or have a third party print, a poster reproducing a La Jonx creation from a file, photograph, screenshot or image obtained online.

The technical availability of an image on the Internet does not mean that its downloading, reproduction or exploitation is authorised.

Article 5: Professional, commercial and promotional use

Purchasing a physical copy of a poster does not confer any right to exploit separately the visual depicted on it.

Without prior permission from La Jonx, a La Jonx creation may not in particular be reproduced or incorporated into:

• a website or online shop
• an advertising campaign
• a catalogue, flyer, brochure or leaflet
• packaging or a product
• a commercial publication
• promotional material
• or any other form of commercial communication.

Any professional or commercial use requiring reproduction of the visual is subject to prior written permission from La Jonx and, where applicable, a licence.

Article 6: Photographs and social media

The owner of a physical La Jonx poster may photograph the poster while it is displayed in its surroundings and share that photograph, including on social media, provided that such use does not make an exploitable reproduction of the work itself available and does not infringe La Jonx’s rights.

La photographie d’une affiche dans un intérieur, un restaurant, a hotel, a shop or other business premises ou un autre environnement est ainsi autorisée dans le cadre d’une présentation normale de cet espace.

However, extracting, cropping or reproducing the visual itself for use as an illustration, graphic element, advertising material or printable file requires La Jonx’s prior permission.

Article 7: Licences

La Jonx may grant licences permitting certain uses of its creations, including reproduction, distribution or commercial, promotional or digital use.

Any licence must be agreed in writing in advance and must specify, in particular, the work concerned, the authorised use and its duration.

Unless otherwise agreed in writing, a licence does not transfer any intellectual property rights in the work.

Article 8: Reference licence fees

For uses requiring permission from La Jonx, the reference licence fees include the following:

Reproduction and/or display of a visual without purchasing the corresponding physical copy:
CHF 3,000 per work and per location.

Reproduction and distribution:
CHF 2,000 per work and per batch of 100 copies.

Online use for professional, commercial or promotional purposes:
CHF 2,500 per work and per month of use.

These amounts are the reference fees charged by La Jonx for granting the corresponding usage rights. 

La Jonx remains free to offer different terms or fees depending on the nature, duration and scope of the project, the territory, the number of reproductions and the rights requested.

Payment of a licence fee following unauthorised use does not automatically regularise that use and grants no future rights without a written agreement from La Jonx.

Article 9: Unauthorised use

Where a La Jonx creation is reproduced or used without permission when such permission is required, La Jonx may, in particular, demand that the use cease and assert any claims available to it under Swiss law.

La Jonx reserves the right to take any steps or proceedings necessary to protect its rights.

Article 10: Website operation

La Jonx s’efforce d’assurer la disponibilité et le bon fonctionnement the www.la-jonx.ch website.

However, La Jonx does not guarantee uninterrupted access to the website or that it will be free from technical errors.

La Jonx may modify, suspend or temporarily discontinue all or part of the website, in particular for maintenance, security or updating purposes.

Article 11: Personal data

Information concerning the processing of personal data is available in the Legal Notice published on www.la-jonx.ch.

Article 12: Governing law

These GTU are governed by Swiss law.

Subject to any mandatory places of jurisdiction provided for by applicable law, the competent courts are those of the Canton of Geneva.

Article 13: Amendments to the GTU

La Jonx may amend these GTU, in particular to reflect changes to the website, its services or applicable legislation.
